GENERAL TERMS OF USE FOR THE LOGIN AREA

The German Olympic Sports Confederation e.V., Otto-Fleck-Schneise 12, 60528 Frankfurt am Main (hereinafter "DOSB"), the German Sport University Cologne, Am Sportpark Müngersdorf 6, 50933 Cologne (hereinafter "DSHS") and the Öko-Institut e.V., Rheinstr. 95, 64295 Darmstadt, offer a login area for users of the "Sustainable Sport Events" platform, which enables exchange opportunities with other organisers as well as the search and offering of expertise (including contact options). Registration of the respective user is required to use the login area. Use of the login area is subject to these General Terms and Conditions of Use (hereinafter referred to as "GTCU").

 

1. SCOPE OF APPLICATION AND GENERAL INFORMATION

1.1 The DOSB, DSHS and the Öko-Institut provide the platform or parts thereof free of charge to users registered in accordance with these GTCU in accordance with these GTCU. "Users" within the meaning of these T&Cs are natural persons who wish to use the login area of the platform provided by the DOSB, DSHS and the Öko-Institut on the Internet free of charge

1.2 These GTC shall become effective for the user upon registration of the user

1.3 § Section 312i (1) nos. 1, 2 and 3 BGB and Section 312i (1) sentence 2 BGB do not apply to contracts in electronic commerce.

1.4 The sole contractual language is German. 

2. SCOPE OF SERVICES

2.1 The DOSB, the DSHS and the Öko-Institut make the login area available to users free of charge. There are no claims to specific services, in particular specific functionalities, a specific design (e.g. interfaces) or a specific availability.

2.2 The platform is accessed via the internet. The user is responsible for Internet access and the hardware (e.. notebook, tablet) or software (e.g. browser) required to access the platform. 

2.3 The platform is provided to the user exclusively as software as a service ("SaaS") that can be used in the browser. The DOSB, the DSHS and the Öko-Institut reserve the right to modify, expand or reduce the functional scope of the platform at any time at their own reasonable discretion (§ 315 BGB), taking into account the interests of the user and the cooperation partners, or to discontinue it permanently or temporarily. There is no entitlement to the provision of the platform with certain functionalities. The DOSB, the DSHS and the Öko-Institut are authorised to operate the platform themselves or through third parties.

2.4 The DOSB, the DSHS and the Öko-Institut are authorised to amend these T&Cs. The DOSB, the DSHS and the Öko-Institut will notify the user of changes to these GTC in writing or by e-mail to the contact address provided six (6) weeks before they come into force. The user will be notified of the changes and the deadline for objection and informed of the consequences of objection. The objection can be sent by e-mail to the address provided. If the user does not object to the change in writing or by e-mail within a period of 30 days from receipt of the notification of change, the change shall become part of the contract. If the user objects, the parties shall mutually agree on a solution at . In the event of failure to reach agreement, the DOSB, DSHS and the Öko-Institut are authorised to terminate the contract.

2.5 Availability: The DOSB, the DSHS and the Öko-Institut have no influence on the availability of the platform and can therefore not guarantee its availability.

3. USE OF PLATFORM

3.1 The Platform is accessed via the Internet using a current browser supported by the Platform. The user is responsible for his/her own internet access (in particular availability, bandwidth) and the provision of the hardware and applications (in particular browser, plugins, apps) required to use the platform.

3.2 Access to the login area of the platform requires the user to register. Access is personalised, cannot be shared with third parties and cannot be transferred to third parties. The username and password must be kept secret by the user.

3.3 Once the user account has been initially set up by the user, the user can use the login area. When registering, contact details and any other information required for registration must be provided completely and correctly. Registration takes place by entering the required information in a form provided for this purpose on the platform. After successful registration, the DOSB, the DSHS and the Öko-Institut will send the user an e-mail confirming successful registration. There is no entitlement to registration.

3.4 The information provided by the user must be complete and truthful and must be updated immediately by the user in the event of subsequent changes. There is no entitlement to a specific identifier for the user account. Identifiers chosen by the user for the platform must not infringe any third-party rights, in particular no rights to names or trademarks.

3.5 Passwords must be kept secret by the user, protected against misuse and changed in accordance with the current state of the art. The user must inform the DOSB, the DSHS or the Öko-Institut immediately in text form in the event of misuse or suspected misuse. In the event of misuse, the user shall be liable; this shall not apply if the user is not responsible for the misuse.

4. RIGHTS OF USE

4.1 The user shall receive a simple right of use for his/her own purposes, limited in time to the respective use of the login area and in substance to the utilisation of the services provided by the DOSB, the DSHS and the Öko-Institut in accordance with these GTC. 

4.2 The DOSB, the DSHS and the Öko-Institut grant users access and editing rights that allow them to create, read, delete and export their own data records. 

4.3 The DOSB, the DSHS and the Öko-Institut exclusively provide the technical and organisational framework for the use of the functions for the purposes specified in these GTC. With regard to the texts, data, information, images, graphics, videos or other content (hereinafter referred to as "information") posted in the login area via the user's access, the DOSB, the DSHS and the Öko-Institut are merely technical service providers for third-party information. Own information is expressly labelled as such by the DOSB, the DSHS and the Öko-Institut or is general information on the use of the login area.

4.4 The user grants the DOSB, the DSHS and the Öko-Institut a free, unlimited and transferable right of use to third parties for all content/information (e.g. texts, images) posted by him/her, insofar as this is necessary for the operation of the platform in order to publish the content on the platform, to reproduce it and to make it accessible to other users. The user is prohibited from posting content/information for which he is not the author or is otherwise not authorised to grant rights of use. This also applies if the user makes personal data of third parties accessible via the platform.

5. OBLIGATIONS OF THE USER

5.1 The user is responsible for complying with the legal regulations with regard to the information posted or otherwise filed by him. Should the user or a third party become aware that such information violates the rights of the DOSB, the DSHS, the Öko-Institut, other users or third parties, the DOSB will investigate the allegation and, if necessary, block access to the information concerned or delete it. A corresponding contact option is available on the platform under "Contact". The same applies if there is a risk of misuse of the platform by third parties who are not authorised to use it. The assertion of further claims remains unaffected. 

5.2 The user may not misuse the platform for extraneous or illegal purposes. In particular, the user is prohibited from 

  • post content that contains personal data of third parties without a legal basis; 
  • violate the data subject's right to their own image without their consent; 
  • use mechanisms, software or scripts that go beyond the functionalities and interfaces provided on the platform by the DOSB, the DSHS and the Öko-Institut, in particular if this blocks, modifies, copies and/or overwrites functions of the platform;
  • to attempt to access the security systems used by the DOSB or the information available on the platform by means of data alteration (§ 303a StGB), computer sabotage (§ 303b StGB), falsification of evidential data (§§ 269, 279 StGB), suppression of evidentiary data (§ 274 StGB), computer fraud (§ 263a StGB), spying on data (§ 202a StGB), interception of data (§ 202b StGB), data theft (§ 202d StGB) or other criminal offences;

5.3 The user is obliged not to use the platform in an improper manner. This includes, in particular, the deliberate input of incorrect data and the falsification of existing data. 

5.4 Criminal offences or administrative offences committed by the user during and in connection with the use of the platform may be reported by the DOSB, the DSHS or the Öko-Institut to the competent public prosecutor's office.

5.5 The DOSB, the DSHS and the Öko-Institut reserve the right to take legal action against the user if one or more of the above obligations are violated. 

5.6 The obligations incumbent on the user under the contract remain unaffected by this.

6. CONFIDENTIALITY AND DATA PROTECTION

6.1 The user undertakes to maintain confidentiality towards third parties with regard to all confidential matters, documents, business and trade secrets, as well as comparable processes from the area of the platform or the participating organisations that otherwise become known to him during the period of access granted to him to the login area or parts of the platform. In particular, the user undertakes to treat all documents and other content made available to him as confidential.

6.2 The DOSB, the DSHS and the Öko-Institut process the personal data of users under joint responsibility in accordance with Art. 26 GDPR for the purpose of providing the platform and the login area. The essence of the agreement on joint responsibility can be found in the data protection information.

6.3 The user processes personal data with the platform. In doing so, the user shall comply with the statutory provisions, in particular the provisions of the General Data Protection Regulation (hereinafter "GDPR").

6.4 All information on the handling of personal data by the DOSB, the DSHS and the Öko-Institut as the operator of the platform can be found in the data protection information, which can be accessed at any time on the respective event page on the platform

7. LIABILITY OF THE DOSB, THE DSHS AND THE OEKO-INSTITUT

7.1 Subject to the following provisions, the DOSB, DSHS and the Oeko-Institut shall be liable in accordance with the statutory provisions. This also applies to its legal representatives, vicarious agents and subcontractors. 

7.2 The liability of the DOSB, the DSHS and the Oeko-Institut is excluded in cases of simple negligence. The above limitation of liability shall not apply in the event of damage resulting from negligent injury to life, limb or health, material contractual obligations or for liability under the Product Liability Act. 

8. FINAL PROVISIONS

8.1 No verbal collateral agreements were made.

8.2 Amendments and supplements to these T&Cs must be made in text form to be effective.

8.3 Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions of the respective agreement. The law shall apply in place of the invalid provision.

8.4 German law applies.
